Terms and Conditions


Contract for the Supply of Products or Services

We must receive payment of the total price for the goods that you order before your order can be accepted. Once we have received your payment we will confirm that your order has been accepted by sending an email to you at the email address you provided at the time of your order. Our acceptance of your order brings about a legally binding contract between us. By placing your order you confirm that you agree to use your correct name, address and any other details we may reasonably request.

Availability of Goods

All goods advertised for sale on our site are subject to availability. If an item is out of stock and cannot be supplied within normal delivery times we will inform you by e-mail or by telephone of the anticipated delay. Please see our Delivery & Postage page.

We have displayed the jewellery on the site as accurately as possible, however as all items are individually handmade slight variations in colour and design are to be expected and orders can only be taken on the understanding that the buyer fully appreciates that this is the case. The colours shown on your monitor may also vary a little from the colour of the original jewellery and you should not expect to make an exact colour match with clothing etc., based on these reproductions.

Prices

The prices payable for goods that you order from us online are set out in our website and are correct at the time of display. However we reserve the right to alter prices from time to time without notice.


Cancellation by you

We hope that you will be completely happy with you purchase. However, should you wish cancel your contract with us you may do so at any time up to the seventh working day from the date you receive the ordered goods. You do not need to give any reason for cancelling your contract with us. To cancel your contract you must notify us in writing to our postal address- 41 Stonehouse Road, Bromsgrove, Worcs B60 2JY or to our email address – info@enamelled- jewellery.co.uk. If you have received the goods before you cancel your contract then you must send the goods back to us at our postal address (as given above) at your own cost and risk. If you cancel your contract but the goods are in transit you must not unpack the goods when you receive them and you must send the goods back to us at our postal address (as given above) at your own cost and risk as soon as possible. Once you have notified us that you are cancelling your contract any sum debited to us from your credit/debit card will be re-credited to your account as soon as possible provided that the goods in question are returned in the condition they were in when they were delivered to you.





Cancellation by us

We reserve the right to cancel the contract between us if:
We have insufficient stock to deliver the goods you have ordered:
We do not deliver to your area: or
One or more of the goods was listed at an incorrect price due to a typographical error.
If we do cancel your contract we will notify you by email and will re-credit your account any sum deducted by us from your credit/debit card as soon as possible. We will not be obliged to offer additional compensation for disappointment suffered.

Payment Information

We accept payment through Paypal., you do not need a Paypal account. Original Kiln-fired Enamelled Jewellery and enamelled-jewellery.co.uk are names used for conducting our online business to help internet users to understand the nature of our website. The trading name of our business is Real Charmer, and this the name which will appear on your credit/debit card statement.
Credit and charge card payments are subject to validation and authorisation by the card issuer and we will not be liable for any non-delivery or delay if a card issuer refuses to authorise payment.
You may also pay for goods by sterling cheque drawn on a UK clearing Bank but the goods will not be dispatched until the cheque has cleared.
Transmission of your debit or credit card number and other details in relation to payment will be at your own risk. We cannot accept responsibility or liability for failures in transmission of information deletion, non-delivery or failure to store any communications by you.

Liability

If the goods that we deliver are not what you ordered or are damaged or defective or the delivery is of incorrect quantity we shall have no liability to you unless you notify us in writing of the problem within 10 working days of delivery of the goods in question at our email or postal address.
If you notify us of a problem under this condition our sole and exclusive obligation will be at your option: a) to make good any shortage or non- delivery b) to replace or repair any goods that are damaged or defective; or c) to refund you the amount paid by you for the goods in question whatever way we choose.

Nothing in these terms and conditions is to be taken to exclude or restrict your statutory rights in respect of goods supplied. We do not accept responsibility for damage to goods caused by you.
We will not be responsible for claims relating to the availability of our range, our ecommerce engine, or our website.

Dispatch of Goods

We will deliver the goods to the address, which you have given us at the time you make your purchase.
Delivery will be made as soon as possible after your order. We will endeavour to ensure that the goods are delivered by any delivery date estimated by us but we cannot guarantee that goods will be delivered by that date. You agree that we will not be liable to you for any loss, damage or charge incurred because of the late delivery of goods.
Once the goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

General

Any failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of those terms and conditions.
These terms and conditions may be subject to change at any time without prior notice to you.

Jurisdiction

These terms and conditions shall be governed by and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Courts.

Events beyond our Control

We shall have no liability to you for any failure to deliver any goods that you have ordered or any delay in doing so or any damage or defect to goods delivered that is caused by an event, or circumstance beyond our reasonable control, including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

We only use information about you to process your order. We will not e-mail you in the future unless you have given us your consent. We do not disclose buyer’s information to third parties except for delivery purposes. The type of information we will collect about you includes your name, address, phone number, and email address. We do not store or have access to your credit/debit card details. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information, which we hold, will be held securely.

Third Party Rights

Notwithstanding any other provision of the contract between us, nothing in the contract between us confers or purports to confer any right to enforce any of its terms on any person who is not a party to it.
